Fort Worth Court of Appeals Protects Rights of Injured Persons

The Texas Tort Claims Act provides a limited waiver of governmental immunity.  The duty owed by the government—here, the City of Fort Worth—is the greatest when an injured person pays for the use of the premises.  In a personal injury appeal argued by lawyer Steve Samples of Samples Ames PLLC, the Fort Worth Court of Appeals held that “pays for the use of the premises” means exactly what it says, rejecting arguments by the City of Fort Worth that the presence of other people, who might not have paid for that right, is somehow significant.  Click here to read the full opinion:
